Version: terms-2026-10-19
Effective date: 2026-10-19
1 The service and these Terms
KMSTRY is a social-discovery service for adults, with personal accounts and venue tools for friendship, social interaction and networking. It is operated by Bright Minds Hub Marketing Management LLC, Office 2703, Concord Tower, Dubai Media City, Dubai, United Arab Emirates (“KMSTRY”, “we”, “us” or “our”). Contact us at adops@brightmindshub.net or +971 4 494 1211.
These Terms govern your use of KMSTRY and associated account and invitation pages. By accepting these Terms you agree to them. Our Privacy Policy explains information handling; acknowledging that policy is not blanket consent to unrelated processing. Our Child Safety Standards form part of these Terms and are reproduced in their publication version.
If you act for a venue or company, you must have authority to do so. The legal rights that apply to you as a consumer, data subject or other protected person are not removed by these Terms.
2 Eligibility and account security
You must be at least 18 years old and legally able to enter this agreement. Give accurate registration information, including age information when requested. Do not impersonate another person, misrepresent your authority over a venue or use another account to evade a restriction.
Keep login credentials secure and tell us promptly if an account may be compromised. Do not share a password with venue staff; use authorised team invitations and roles. You are responsible for your own use of the service, but these Terms do not automatically make you responsible for every unauthorised act by a third party.
We may require verification appropriate to the feature or risk. An invitation, paid-feature access, check-in or venue claim does not override an account ban or an eligibility restriction. Team membership does not transfer ownership of another person's personal account.
3 Profiles and interacting with other people
Share only information you are comfortable making available to the audience of the selected feature. Profile and check-in visibility is explained in the Privacy Policy; your full date of birth is not a public profile field. Anonymous Mode is limited to supported features; it is not a promise of anonymity from KMSTRY or from people you message or otherwise identify yourself to.
Treat other people respectfully. We do not guarantee another user's identity, intentions or physical presence, and a profile, match or venue connection is not an endorsement. Use appropriate care when meeting someone. Do not rely on KMSTRY as an emergency, safeguarding or identity-verification service.
4 Check-ins and Moments
A check-in requires the conditions shown in the app, including location eligibility and an acceptable Moment where required. You must not falsify your location or use a misleading photo to imply a presence you do not have.
The first required Moment must be approved before the check-in becomes active and gives access to the associated room. A pending preview does not mean that your check-in is active or that other users can see the content. Check-ins normally expire after three hours and may end earlier because of checkout, eligibility changes, removal of required content or enforcement action.
Check-ins cannot be extended. To return, you will need to create a new check-in and submit a new Moment. Cancelling a pending check-in does not grant room access, and a cancelled check-in will not be reactivated by a later moderation decision.
5 Stories and other public content
Personal stories follow the lifecycle of their associated check-in. Venue stories normally remain available for 24 hours unless removed earlier. Visibility expiry is different from the retention of records described in the Privacy Policy. We do not guarantee that content remains available for its full potential lifetime.
Public photo uploads and supported text are subject to safety processing. Public video uploads and venue-verification video submission are not currently available. Do not attempt to bypass disabled functions or upload restrictions through another route.
Your own pending preview may appear before a post is available to anyone else. We do not promise immediate publication, a fixed moderation time or that technically successful uploading means approval. You may cancel or remove content through the applicable controls. Deleting or cancelling content does not entitle anyone to restore it through a later approval.
6 Content you may not share
You must not use KMSTRY to create, upload, send, promote or facilitate:
- Child sexual abuse or exploitation, including grooming, sexual solicitation of minors, sextortion, trafficking, or child sexual abuse material. This includes unlawful or exploitative synthetic, manipulated or AI-generated depictions. A person under 18 is a child for these standards.
- Non-consensual intimate imagery, sexual exploitation, or sexual and nudity content prohibited by our safety rules.
- Credible threats, incitement to violence, terrorism, targeted harassment, bullying, hate or unlawful discrimination.
- Fraud, scams, identity deception, unsolicited spam, or attempts to obtain passwords, verification codes or confidential information.
- Unlawful disclosure of someone else's personal information, stalking or attempts to identify anonymous guests.
- Material that infringes another person's copyright, trademark, privacy, publicity or other rights.
- Illegal transactions, malware, security attacks, or instructions intended to compromise KMSTRY or another person's account.
- Content or conduct that otherwise violates applicable law or these Terms.
- Content that breaches applicable UAE laws, including laws concerning public order or public morals.
Context matters when applying safety rules, but it does not justify exploiting children or distributing illegal material. Do not upload suspected child sexual abuse material to demonstrate a problem, test the system or appeal a decision. Report identifying references instead.
7 Moderation and reports
We use automated checks, including AWS image and text safety services, user reports and authorised human review. The Privacy Policy explains the data involved. Where a specific permission is required, acceptance of these Terms does not replace that permission.
Content may be blocked, held for review, removed or restricted. An uncertain reading of image text or a service failure can prevent immediate publication without proving wrongdoing. We may restrict or suspend an account when warranted by the seriousness, repetition or risk of the conduct. Where appropriate and lawful, we will explain the action and offer a way to seek review. We may limit the explanation to protect another person, an investigation or security controls.
Use the report controls on relevant content or profiles, or contact our support address. Blocking is available in supported user-interaction features. We assess reports under these Terms and the Child Safety Standards; a report is not an automatic finding against a person. We may keep limited decision and case records where justified, subject to the Privacy Policy and applicable law.
You can request reconsideration by identifying the account or content and explaining the issue. Do not send illegal media, account passwords or unnecessary personal information. An appeal does not automatically restore content or suspend a protective restriction. Automatic checks and human review cannot guarantee detection of every harmful item.
8 Your content and permissions to use it
You retain the rights you own in your content. You must have the necessary rights and permissions to submit it and to allow its use for the selected KMSTRY feature, including permission required for images of other people. Photographing or sharing images of people without their consent may be a criminal offence in the UAE, depending on the circumstances and applicable law.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, display and technically adapt your content only as reasonably necessary to provide the selected service, operate safety and support processes, and meet legal obligations. We may use service providers for those purposes. This licence does not transfer ownership to us or authorise us to use private messages or verification documents as advertising.
The licence follows the content's intended visibility and ends when the relevant content is deleted from our systems, except to the extent needed for lawful retention, backup expiry or another continuing service use you authorised. Copies independently retained by another recipient are not controlled by that licence ending.
KMSTRY branding and software belong to us or their respective rights holders. Third-party maps, photos and other licensed material remain subject to the rights and attribution conditions that apply to them. Do not remove required attribution or copy provider content beyond the rights granted for using the feature.
Use of the Google Maps and Places features is also subject to the Google Maps/Google Earth Additional Terms of Service, incorporated here for those features, including the applicable Google terms referenced there. Google's attribution and contributor information must remain available as required. Showing a business or provider photo does not mean that Google or the business endorses KMSTRY.
If you believe material on KMSTRY infringes your rights, contact us with a description of the protected work, the affected content reference, your contact details and an explanation of your authority to report it. Do not provide private documents or additional copies of sensitive content unless they are needed through an appropriate secure process. We review notices and take action under the applicable law; a complaint does not itself prove ownership or infringement.
9 Venue teams and verification
Venue owners and authorised administrators must maintain accurate venue information and grant only appropriate team access. Use the team-management tools to change or revoke access when a member leaves. Role-based access and access to optional features are separate controls; being an owner does not automatically make every optional product feature available.
Provide genuine claim and business-verification documents that you are authorised to submit. They are used for verification and related security or legal purposes, not as public marketing photos. Do not include unnecessary personal information. Acceptance of a claim is not a government certification or a guarantee that every document has been independently authenticated.
Venue personnel must not misuse guest information, contact guests for unauthorised marketing, identify anonymous guests, scrape profiles or export data beyond their legitimate authority. Venue operators are responsible for their own business information, offers, events and independent data use.
10 Events and offers
Event saving, an interest indication or “Add to my calendar” is not a booking, reservation, ticket purchase or confirmation of entry. Unless a separate feature explicitly provides it, KMSTRY does not reserve a place for you or process a transaction with the venue.
Event details, schedules, availability, eligibility and offers are supplied by the relevant venue and may change. Check material conditions with that venue. Venue operators must describe their offers accurately and honour obligations that apply to them. A recurring-event edit or removal may affect future instances as explained by the selected control.
11 Paid features
Any paid subscription or feature will have its price and terms shown before you agree to pay. These Terms do not authorise any charges or sign you up for marketing emails.
12 Availability and prohibited technical use
We work to provide a reliable service but do not guarantee uninterrupted availability or a fixed upload or review time. Maintenance, network problems and provider failures may affect features. These statements do not exclude obligations that cannot lawfully be excluded.
Do not interfere with safety checks, access another user's data without authority, bypass bans or rate limits, overwrite an approved upload, exploit a vulnerability or use automated collection that is not authorised. Report security concerns privately with enough detail to investigate, without exposing other people's data.
13 Leaving or losing access
You can stop using KMSTRY, leave a venue team where supported or request account deletion. Deleting only a personal profile is different from deleting the entire account. The Privacy Policy explains deletion routes and limited retention.
We may suspend, restrict or terminate access for a material breach, a legal requirement or a credible safety or security risk. Where appropriate we will provide a reason and review route. A ban cannot be bypassed with a different account or a team invitation.
Termination does not remove mandatory access, deletion, complaint or consumer rights. Relevant business records may belong to a venue as well as relate to your account. Rights and obligations that necessarily continue, such as justified legal retention and resolving an existing dispute, continue only to the extent applicable.
14 Responsibility and limitations
Each party remains responsible for its own conduct and for obligations imposed by applicable law. We are not the organiser of an independently operated venue event and do not guarantee third-party statements, conduct or availability. We remain responsible to the extent the law makes us responsible for our own service or actions.
Only to the extent permitted by applicable law, our total liability for claims arising from these Terms or the service is limited to the greater of the amount you paid to KMSTRY in the 12 months preceding the claim and AED 500. To the extent permitted by that law, we are not liable for indirect or consequential losses. These limitations do not apply to responsibilities, liability or remedies that cannot lawfully be limited, including mandatory consumer and data-protection rights.
To the extent permitted by applicable law, you are responsible for third-party claims directly caused by your unlawful content, fraud or intentional misuse. Any indemnity is limited to reasonably incurred losses attributable to that conduct; it does not transfer responsibility for KMSTRY's own unlawful acts or non-excludable duties to you. Applicable consumer protections prevail.
15 Governing law and disputes
These Terms are governed by the laws applicable in Dubai and the United Arab Emirates, without depriving a consumer of mandatory protections available under the law that applies to them. Please contact us first so that we can try to resolve a dispute. Doing so does not prevent you from seeking urgent relief or using a regulator, mandatory complaint process or court available to you by law.
Where a valid arbitration agreement is enforceable under applicable law, a dispute unresolved after 30 days may be referred to the Dubai International Arbitration Centre (DIAC) under its rules, seated in Dubai and conducted in English. This provision does not remove mandatory consumer court rights, regulatory complaint rights, access to urgent relief or other non-waivable rights. Any translated version must be interpreted consistently with applicable mandatory language and consumer requirements.
16 Changes and contact
We will identify the effective version of these Terms and give appropriate notice of material changes. Where renewed agreement is required, we will request it. A change does not retrospectively authorise processing or remove rights that have already arisen.
If a provision is unenforceable, the remaining provisions apply to the extent the law permits. These Terms and any clearly identified feature terms govern the service, but cannot override statutory rights.
For support or questions about these Terms, contact adops@brightmindshub.net. For child-safety concerns, contact deniz@brightmindshub.net or use the reporting channels in our Child Safety Standards. Do not send suspected child sexual abuse material by email. For an immediate danger, contact the emergency services appropriate to your location; KMSTRY is not an emergency-response service.
Child Safety Standards
1 Our standard
KMSTRY is an adult social-discovery and venue platform operated by Bright Minds Hub Marketing Management LLC. You must be at least 18 to use it. We prohibit child sexual abuse and exploitation, including child sexual abuse material, across profiles, messages, images, text, venue content and all other uses of the service. For these standards, a child is anyone under 18.
Being an adult-only platform does not exempt KMSTRY from addressing harm involving children. These standards apply to personal users, venue owners, team members and anyone acting through an account.
2 Prohibited content and conduct
You must not use KMSTRY to:
- Share, request, produce, promote or distribute child sexual abuse material or sexualised depictions of a child, including exploitative manipulated or AI-generated depictions.
- Groom a child, solicit sexual contact or content from a child, or facilitate an adult's sexual exploitation of a child.
- Threaten, coerce, blackmail or extort someone in connection with child sexual content or exploitation.
- Facilitate trafficking, commercial sexual exploitation of children, or contact intended to enable those acts.
- Promote, normalise or provide access to child sexual abuse or exploitation, including by sharing links or instructions to obtain abusive material.
- Disclose information in order to endanger or exploit a child, evade enforcement, or recruit others to participate in this conduct.
Do not distribute suspected illegal material as a warning, test, report or appeal. Reporting an item does not require downloading it, taking a copy or sending it to other users.
An underage account is also prohibited even if no sexual abuse is involved. A report of an underage account and a report of child sexual exploitation may require different investigations; neither should be ignored because the service is intended for adults.
3 How to report a concern
Use the in-app Report control on the relevant profile or content and choose Child safety concern. Describe the concern and identify the account, content, message, venue or event involved. If your version's categories do not name child safety, select the closest relevant category or Other and clearly describe the concern. A child-safety report does not become less important because it was submitted under another category.
If you cannot use an in-app report, contact deniz@brightmindshub.net with the subject “KMSTRY child safety concern”. Provide identifiers or links within KMSTRY, relevant dates and a brief explanation. Do not attach suspected child sexual abuse material, passwords or verification codes. We may ask for limited additional information through an appropriate secure process.
You can also block the relevant user through supported controls. If someone faces immediate danger, contact the emergency services or child-protection authority appropriate to their location. KMSTRY is not an emergency service and this contact channel does not guarantee a real-time response.
4 How we respond
We prioritise reports indicating possible child abuse or exploitation and assess them through authorised safety personnel. Depending on the risk and findings, we may limit visibility, remove content, restrict interactions or suspend or terminate an account. We do not wait for a public complaint or a final criminal finding before taking a protective action that is justified by our rules and applicable law.
Automated image and text checks assist this process, alongside user reports and human assessment. They do not reliably establish age, confirm the legal status of every image or detect every harmful interaction. An automated approval is not proof that a child-safety concern is unfounded.
We remove known child sexual abuse material from access through the service and follow the reporting obligations that apply to us. Confirmed cases are escalated to the appropriate regional authority or, where applicable, the National Center for Missing & Exploited Children (NCMEC). The applicable authority and process depend on the facts and governing law; not every ordinary user report is automatically sent to an external organisation.
We may limit what we disclose about an investigation to protect the affected person, a reporter, lawful proceedings or security controls. We prohibit retaliation against a person for making a good-faith safety report. Deliberately abusive reports can themselves violate our Terms.
5 Handling information safely
Access to child-safety case information is limited to people with an authorised need to act. We do not publish a reporter's identity as part of the report or use case evidence for marketing.
We retain only information justified for the safety investigation, an applicable legal obligation or a valid preservation requirement, with restricted access and a reviewed retention period. Removal from public access is different from any lawful preservation. Suspected illegal material must not be copied into ordinary email, chat, task trackers or general application logs.
Account or content deletion does not override a valid preservation requirement. It also does not justify keeping all account data indefinitely: unrelated data remains subject to the applicable deletion process.
See our Privacy Policy for further information about processing, providers, retention and privacy requests.
6 Decisions and review
If you believe we made an error, contact support with the account or content reference and explain why. Do not resubmit suspected illegal material. An appeal does not automatically restore content or remove an interim protective restriction. We may be unable to disclose protected case details or take a requested action where law or another person's safety prevents it.
We review these standards and the associated reporting process as the service or legal requirements change. Child-safety enquiries are handled through our designated point of contact and authorised support process. The company remains responsible for operating that process and responding to appropriate authority enquiries.
For general questions about these standards, use deniz@brightmindshub.net.
